
HFSS volume restrictions come into force

Despite the UK Government announcing in July 2025 that they were planning to repeal the HFSS volume promotion restrictions as part of their 10-year NHS plan, these restrictions have now come into force in the meantime.
HFSS volume promotion restrictions means that businesses of a certain size cannot offer for sale volume price promotions on unhealthy foods (including chocolate, crisps, pizza, fizzy drinks, certain savour snacks etc). ‘Volume price promotions’ are offers like: buy-one-get-one-free, 3 for £10, buy 6 save 25%, 50% extra free and 3 for the price of 2.
Importantly certain matters are exempt like multipack items, meals deals or volume price promotions on foods not in scope.
In-scope businesses should carefully determine which foods they sell are caught within scope of the HFSS regulations, and ensure that they do not offer them to consumers as volume price promotions; both at a corporate pricing level and a local store level to stamp out any discretionary pricing.
