
HFSS Regulations Come into Force in Wales

The regulations restricting the location and promotion of products that are high in fat, salt or sugar have now come into force in Wales.
Specified food must not be placed at the end of (but not in) and aisle, where the aisle end is adjacent to a main customer route through the store or on a separate structure connected or adjacent to, or within 50cm, of, such an aisle end. These restrictions apply regardless of their proximity to the ‘main customer route’ through a store
Retailers are advised to ensure that it is clearly communicated to customers that on pack promotions do not apply and that the actual price of the product is clear and unambiguous. There is no transition period for this. This also includes ensuring that self-service tills do not apply the promotional price when the product is scanned.
If found to be deliberately contravening the regulations, enforcement officers may issue an improvement notice which could result in a fixed penalty notice of £2,500 if not complied with, or prosecution.
