Construction client sentenced after the death of a worker on site

An individual assigned as client under Construction (Design and Management) Regulations 2015 (CDM) has been sentenced to a 12-week suspended prison sentence. 

Police found a worker’s body at a construction site who was believed to have died of natural causes. Health and Safety Executive (HSE) conducted further investigations which uncovered several failures of health and safety law. 

 HSE took action against the construction client in their individual capacity for the breaches identified during their investigations. Whilst the breaches were not the cause of the individual’s death, the failings identified, including putting workers at risk of falling from height, were substantial enough for HSE to bring criminal proceedings against the individual. 

Businesses should keep in mind that the main reason for the HSE visit will not stop further investigations into other breaches of Health and Safety.
