A construction company and its director have been fined after failing to comply with enforcement notices

A construction company and its director has been fined for failing to comply with various enforcement notices. The company pleaded guilty to breaching Regulation 15(2) of the Construction (Design Management) Regulations 2025 and two counts of failing to comply with the Prohibition notice contrary to s.22(1)(g) of the Health and Safety at Work etc Act 1974 (HSWA). The director pleaded guilty to breaching s.37(1) of etc HSWA.

The enforcement notices were in regard to multiple safety failures, such as failing to suitably plan, manage, and monitor construction work. The company had also failed to implement adequate work at height practices.

The company was fined £7,200, and the director was fined £10,800.

The Health and Safety Executive (HSE) has stressed that these fines should serve as a reminder to construction companies that they take failing to comply with enforcement notices very seriously.

Companies should ensure that when they receive communication from the HSE, they treat the letter or notice seriously and take care in both responding to and actioning its points to avoid incurring any fines.
