Company fined £266,666 after child injured by falling shards of glass

A 12-year-old girl was injured after she was hit by falling shards of glass at the company’s Christmas lights event. A snow machine had fallen from a window above where visitors gathered for the event.

The company failed to properly secure the machine which fell out of the building, hitting a light on its descent which shattered. A shard of glass fell towards the girl’s head and the girl suffered a deep cut as a result, requiring hospital treatment.

The HSE found that the company failed to properly risk assess the machine and failed to ensure it was secured. The manufacturer had explicitly demonstrated how to safely install the machine.

The company pleaded guilty to breaching Regulation 10(1) of the Work at Height Regulations 2005 and Section 3(1) of the Health and Safety at Work etc. Act 1974 and was fined £266,666 and ordered to pay costs of £4931.
