CMA fines Euro Car Parks for failure to comply with notice

The Competition and Markets Authority (CMA) issued its first penalty using its new fining powers under the Schedule 5 Consumer Rights Act 2015 (as amended by the DMCCA 2024) to Euro Car Parks, totalling £473,000.

Euro Car Parks was first issued with an information notice in July 2025. The CMA subsequently made 7 attempts to receive a response from Euro Car Parks, delivering by post, hand, and emails to the company directors, but did not receive anything.

It was only 3 months later, when the CMA told Euro Car Parks that they intended to issue them with a fine for non-compliance, was the necessary information provided. The company stated that they believed the correspondence was fraudulent.

Euro Car Parks also tried to stop the CMA from naming the company by applying to the High Court for an injunction, but the application was refused.

The new fining powers for this type of breach allow the CMA to issue a fixed penalty of up to 1% of the company’s annual turnover.
