CMA updated guidance on unregulated legal services
Friday 13th February 2026
The Competition Markets Authority (CMA) have updated its guidance for unregulated will-writing, online divorce and pre-paid probate services (unregulated legal services) to reflect changes from the DMCCA.
The guidance informs businesses that provide unregulated legal services that they should:
- Ensure compliance with their wider legal obligations and industry standards
- Consider reviewing their own practices and implementing changes to align with the guidance.
- Ensure that they provide consumers with the information needed to make informed choices.
- Ceasing any aggressive or misleading trading practices.
- Ensure that services are performed with reasonable care and skill
- Amend their terms and conditions to ensure that they are compliant.
The guidance reminds businesses that failure to comply with consumer protection law can result in the CMA imposing fines and requiring changes.
