Roofer prosecuted for failing to cooperate with HSE

A roofer has been fined £400 for failing to cooperate with the Health and Safety Executive (HSE) during an investigation. The roofer pleaded guilty to section 20(2) of the Health and Safety at Work etc. Act 1974 (HSWA).

The HSE visited the roofer following concerns after workers had been observed carrying out roof replacement work without any scaffolding being in place. A prohibition notice was served on the roofer. Because of this, further information was requested from the roofer, however he had failed to comply with the s.20 HSWA request.

A s.20 information request compels individuals to cooperate with the HSE during inspections and investigations. The roofer had failed to comply, was verbally abusive towards the inspector and continued to complete the roofing work without the scaffolding despite the prohibition notice.

A warrant for his arrest was issued after he had failed to attend court. The roofer pleaded guilty and was compelled by the Courts to provide the HSE with the required information.
