
ASA upheld complaint on unsafe overtaking advert

The complaint for a TV and video‑on‑demand ad for a confectionery company was upheld for depicting unsafe overtaking on a public road. ASA determined the ad condoned dangerous driving behaviour, in breach of CAP Code rules requiring marketers to avoid promoting irresponsible or unsafe actions.
The ruling emphasises the ASA’s strict stance on portrayal of risky conduct: any depiction of unsafe driving, even in jest, must not be suggestive of normalising or endorsing such behaviour.
