Retention of Title Issues

Many white goods suppliers sell goods to retailers subject to retention of title provisions (“ROT”) in their contracts. The ROT acts as a form of security for the supplier as these clauses entitle the supplier to recover these unsold goods in certain circumstances and title to the goods does not pass to the retailer until the supplier has been paid.

One of our clients supplied goods to Comet, and we were asked to assist them in recovering their goods following Comet’s administration. This led to a deal with the administrators where our client recovered nearly £3,000,000.
